Terms and conditions

1. Payment Terms

Payments not received within 10 days of due date are subject to a 1.5% monthly late fee (18% APR) or the maximum allowed under New Hampshire law.

2. Assumptions & Exclusions

This estimate assumes:

✔ Existing electrical system is adequate
✔ Installation area is accessible
✔ No hazardous material (asbestos, mold, etc.) present
✔ No hidden structural defects exist

Any variations or unforeseen conditions may require additional charges and a signed change order.

 

3. Change Orders

Any changes to scope, equipment, or conditions require a signed Change Order.
Customer acknowledges that unforeseen conditions (e.g., structural issues, concealed wiring, asbestos, power upgrades) may require additional cost.

 

4. Scheduling & Access

Customer agrees to provide reasonable access to the property.
Contractor is not liable for delays caused by supply chain issues, permitting, weather, or customer-caused delay.

 

5. Permits, Code Compliance & Inspections

Contractor will apply for necessary permits unless otherwise stated.
Customer is responsible for fees related to permitting if not included in the contract price.

6. Ownership of Materials

All installed materials remain property of Contractor until payment is made in full.
Contractor may remove equipment in the event of non-payment, subject to applicable law.

7. Warranty

Contractor Labor Warranty

Contractor warrants workmanship for 12 months from completion unless otherwise stated.

Manufacturer Warranty

Manufacturer warranties apply to equipment only.
Contractor is not responsible for manufacturer defects, warranty processing delays, or exclusions.

Warranty is void if:

  • equipment is serviced by non-authorized personnel

  • filters are not changed or maintenance neglected

  • misuse, improper operation, or customer alteration occurs

8. Exclusions & Limitations

Contractor is not responsible for:

  • existing deficiencies in the electrical system, ductwork, structure, insulation, or attic conditions

  • damage due to weather, freezing, power surges, or acts of God

  • mold, air quality, or condensation issues beyond installation scope

​

9. Liability & Indemnification

Customer agrees to hold Contractor harmless from claims, damages, injuries, or losses arising from:

  • pre-existing conditions

  • customer negligence

  • refusal to permit recommended repairs

  • interference with work or unsafe site conditions

Contractor liability is capped at the contract price.

10. Safety & Hazardous Materials

Contractor may stop work if unsafe conditions exist.
Discovery of hazardous material (asbestos, refrigerant leaks beyond system removal, vermiculite, mold) requires additional charges.
 

11. Customer Responsibilities

Customer agrees to:

  • maintain homeowner’s insurance

  • provide clear and safe work area

  • understand temporary power outages or discomfort may occur during installation

12. Right to Cancel (NH Consumer Law)

Customer may cancel the agreement within 3 business days of signing if the sale occurred at the customer’s home or off-premises, in accordance with New Hampshire consumer protection laws.

13. Default, Collection & Attorney Fees

If Customer fails to pay, Contractor may:

  • suspend or terminate work

  • charge collection costs, attorney fees, and filing fees

​

14. Dispute Resolution

Parties agree disputes will first attempt mediation before litigation.
Venue is New Hampshire courts.

​

15. Entire Agreement

The written proposal plus these terms and conditions constitute the entire agreement.

No verbal promises modify this contract.
